IMPORTANT MARKETPLACE NOTICE ErryGo provides technology and platform-facilitation services. The on-ground task assistance is supplied directly to you by an independent ErryGo Partner under a separate contract. ErryGo Partners are not employees, agents or representatives of ErryGo, and ErryGo does not control their day-to-day manner of performance. To the maximum extent permitted by law, each Partner is solely responsible for the Partner Services and for their own acts and omissions. Please read Clauses 5, 6, 28 and 29 carefully. |

1. Parties, scope and acceptance
These Terms of Use and Customer Services Agreement (“Terms”) are a legally binding agreement between ErryGo Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at B-9/6353, Vasant Kunj, New Delhi 110070, Delhi (“ErryGo”, “we”, “us” or “our”), and the person who accesses or uses the Platform or requests a Task (“Customer”, “you” or “your”).
These Terms govern your access to and use of ErryGo’s customer mobile applications, https://errygo.com, related websites, customer support interfaces and technology systems (together, the “Platform”), and every Booking made through them. The same Terms apply to the app and website; a separate customer agreement is not required unless ErryGo expressly enters into a separate written enterprise agreement with you.
By selecting “I agree”, registering an Account, placing or confirming a Booking, or otherwise using the Platform, you confirm that you have read and accepted the version of these Terms then displayed. Consent must be expressed through an affirmative action; silence, inactivity or a pre-ticked box will not constitute consent. If you do not agree, do not use the Platform or place a Booking.
These Terms incorporate: (a) the Privacy Policy; (b) any safety, prohibited-task, cancellation, refund or claims rules displayed on the Platform; (c) the price, scope, timing and other terms shown for a specific Booking (“Booking Terms”); and (d) any offer-specific terms you affirmatively accept. If there is a conflict, Applicable Law prevails, followed by the Booking Terms for that Booking, then these Terms, then a general policy.
Nothing in these Terms limits any right or remedy that cannot lawfully be excluded, including non-waivable rights under the Consumer Protection Act, 2019 and rules made under it.
2. Definitions
“Account” means the customer account associated with your verified mobile number or other approved credential.
“Applicable Law” means every law, rule, regulation, judgment, order, licence condition or governmental requirement applicable to the relevant person, Task, payment, location or transaction.
“Booking” means a confirmed request through the Platform for Partner Services.
“Customer Materials” means any goods, documents, money, payment instruments, keys, access devices or other property entrusted in connection with a Task.
“ErryGo Partner” or “Partner” means the independently engaged individual who chooses to accept and directly perform Partner Services for a Customer.
“Partner Charge” means the amount charged to you for the Partner Services, excluding ErryGo’s Platform Fee and any separately identified third-party amount or tip.
“Partner Services” means the on-ground task assistance supplied directly by a Partner to a Customer.
“Platform Fee” means the GST-inclusive fee, as displayed, charged by ErryGo for Platform Services.
“Platform Services” means the technology, discovery, matching, communication, payment facilitation, support and related marketplace functions supplied by ErryGo.
“Platform Records” means records generated through or in connection with the Platform, including booking, device, communication, location, route, time, payment, photograph, OTP and support records.
“Recipient” means a person other than you for whom or to whom a Task is requested.
“Task” means the assistance requested through a Booking, including any approved in-Platform change.
“Third-Party Expense” means an amount payable to a merchant, shop, authority or other third party for a purchase, fee, fare, repair, alteration or similar item, separately from the Partner Charge and Platform Fee.
“User Content” means information, instructions, reviews, images, recordings, messages or other content you submit or make available through the Platform.
3. Eligibility and authority
You represent and warrant throughout your use of the Platform that you:
are at least 18 years old and legally capable of entering into a binding contract;
are located in India and will use the Platform only in service areas where it is made available;
will use the Platform for lawful personal or internal business purposes and not resell Platform access unless ErryGo agrees in writing;
have authority to provide every instruction and to deal with every Customer Material involved in the Task; and
will comply with Applicable Law, these Terms and the Booking Terms.
If you place a Booking for a Recipient, premises, business or other person, you represent that you are authorised to do so, have obtained every necessary consent, and will ensure that the Recipient and anyone at the Task location complies with the customer-facing obligations in these Terms. You remain responsible for payment and for their instructions, acts and omissions in connection with the Booking.
A minor may receive incidental assistance only under the direct supervision of a responsible adult and only where the Task is otherwise permitted. A minor may not create an Account, place a Booking or be left in a Partner’s care.
4. Account registration and security
You must provide accurate, complete and current information, including your name, mobile number, address and any billing or tax information requested for a Booking. ErryGo may verify information and may refuse or restrict an Account where verification is incomplete or a safety, fraud, legal or operational concern exists.
Your Account is personal and non-transferable. You must secure your device, password and OTP; must not sell, lend, share or duplicate your Account; and must promptly notify help@errygo.com of suspected unauthorised access. You are responsible for activities and Bookings authenticated through your Account except to the extent directly caused by ErryGo’s failure to use legally required security safeguards.
ErryGo may require OTP, identity, payment or other re-verification before permitting a Booking, releasing information, processing a sensitive request or changing Account details. Verification is a risk-control measure and is not a warranty of identity or conduct.
5. Marketplace structure and separate contracts
Two separate supplies For each Booking: (1) ErryGo supplies Platform Services to you and charges the Platform Fee; and (2) the assigned Partner supplies Partner Services directly to you and charges the Partner Charge. The supplies, counterparties and documents are separate even when the amounts are collected in one payment flow. |

5.1 ErryGo operates a technology marketplace that enables Customers to describe Tasks and enables independent Partners to review and accept them. ErryGo does not itself perform the on-ground Task, take possession of Customer Materials, operate a repair shop, supply tailoring or merchant goods, provide professional advice, or become the provider of Partner Services merely because it facilitates a Booking.
5.2 Your contract with ErryGo is limited to Platform Services and is governed by these Terms. Your contract for Partner Services is directly with the Partner assigned to and accepting the Booking, on a principal-to-principal basis, and comprises the relevant Booking Terms together with customer-facing provisions of these Terms concerning the Partner Services.
5.3 ErryGo is not a party to, guarantor of or surety for the contract between you and the Partner. Neither you nor a Partner may bind ErryGo, give a warranty on its behalf, settle a claim for it, or represent that ErryGo performs or guarantees the underlying Task.
5.4 A shop, merchant, repairer, tailor, courier, public authority, building manager or other third party engaged or visited during a Task contracts directly with you where applicable. ErryGo and the Partner are not the seller or provider of that third party’s goods or services unless the Platform expressly states otherwise.
5.5 If Applicable Law treats ErryGo as responsible for collecting, reporting or paying a tax or complying with a non-waivable marketplace obligation, that statutory treatment will apply only to the extent required and does not otherwise convert ErryGo into the supplier of Partner Services or create an employment or agency relationship.
6. Independent Partners; no employment or agency
Every Partner is an independent service provider. Partners are not employees, workers, agents, franchisees, representatives or partners in law of ErryGo, except to the extent Applicable Law conclusively determines otherwise. The expression “ErryGo Partner”, and any identification card, clothing, logo or branding used for trust and identification, is a platform designation only and does not create a partnership, employment or agency relationship.
Partners decide when to make themselves available, may accept or decline individual Tasks, may work independently or through other platforms, ordinarily use their own phone, travel mode and equipment, and are responsible for the lawful method, route and sequence used to perform an accepted Task, subject to the agreed outcome, safety requirements, Booking Terms and proof-of-completion requirements. ErryGo does not control the Partner’s day-to-day manner of performance.
The Partner is also not your employee or general agent. You may communicate the agreed result, material preferences and lawful Task instructions, but you may not require the Partner to exceed the Booking scope, perform an unsafe or unlawful act, make a professional judgment for you, or represent you beyond the limited physical assistance expressly accepted.
No Partner has authority to promise a refund, insurance, compensation, warranty, future service, discount or legal commitment on behalf of ErryGo.
7. Booking requests, confirmation and formation
A Task request is an invitation to Partners and not a guarantee of acceptance, assignment, arrival or completion. A Booking becomes confirmed only when the Platform records acceptance or confirmation and displays the assigned Partner or otherwise communicates confirmation. ErryGo may decline a request before confirmation without liability.
Availability depends on Partner choice, location, time, weather, traffic, demand, Task clarity, safety and other conditions. ErryGo may offer a substitute Partner, revised time, revised scope or cancellation if the selected or assigned Partner becomes unavailable. You may accept or decline a material change.
Booking Terms displayed before confirmation form part of the Booking. Save or review the booking summary, price components, included duration or distance, waiting rules, cancellation terms and any exclusions before confirming.
ErryGo may refuse, pause or cancel a Booking where it reasonably suspects an unlawful, unsafe, prohibited, misdescribed or fraudulent Task; where required information, access or payment is missing; or where fulfilment is not reasonably available. ErryGo is not required to disclose fraud controls, confidential safety information or information whose disclosure could compromise an investigation.
8. Task information, instructions, scope and estimates
You must describe the Task truthfully, specifically and completely before confirmation, including all locations, timing constraints, expected duration, item count, approximate weight or dimensions, stairs or access restrictions, required physical effort, known hazards, third-party appointments, Customer Materials, authorised spending limits, Recipient details and any fact relevant to safety, capability, price or legality.
A price, distance, duration, arrival time, queue time, merchant timeline or completion estimate is indicative unless the Booking Terms expressly state that it is fixed. Actual conditions may differ. ErryGo is not liable for a missed appointment, deadline, queue position, merchant closure, traffic delay or consequential loss arising from reliance on an estimate.
Any material change in scope, location, duration, item, weight, risk, merchant, waiting requirement or spending authority must be recorded through the Platform and may require a revised price and fresh acceptance by the Partner. A Partner may refuse an unrecorded or materially changed request. Instructions given only outside the Platform are at your risk and do not bind ErryGo.
You are responsible for the sufficiency and lawfulness of your instructions and for checking information that requires your judgment. The Partner is not required to infer an undisclosed preference, investigate authenticity, assess legal effect, diagnose a defect or choose among materially different commercial options for you.
9. Partner assignment, substitution and verification
The Platform may display or provide information regarding an assigned Partner as required by Applicable Law, which may include the Partner’s name, photograph, Partner ID, verification status, rating or other aggregated feedback. On a lawful written request after a Booking, ErryGo may provide further information necessary for effective dispute resolution, subject to privacy, safety and Applicable Law.
Partner Accounts are personal. Only the verified Partner whose Account accepted the Task may attend or perform it. If another person arrives, the photograph or identity does not reasonably match, or the Partner asks to substitute another person, do not permit access, do not hand over Customer Materials, and report the issue immediately through support.
ErryGo may conduct identity, address, document, liveness, sanctions, criminal-history or other checks to the extent lawful and operationally available. No check is comprehensive, infallible or a prediction or guarantee of a person’s identity, competence, conduct, safety, honesty or future behaviour. You must exercise ordinary judgment and use available safety features.
10. Charges, taxes and documents
Before confirmation, the Platform will display the total amount then payable and, as applicable, separately identify the Partner Charge, Platform Fee, applicable taxes, discount, waiting or other surcharge, authorised Third-Party Expense and tip. Customer-facing prices are inclusive of applicable taxes unless the Platform expressly states otherwise.
10.1 The Platform Fee is consideration payable to ErryGo only for Platform Services. Unless stated otherwise, it is inclusive of GST and any discount shown against it is treated in the manner reflected in ErryGo’s tax document.
10.2 The Partner Charge is consideration for Partner Services supplied by the Partner directly to you. ErryGo collects it in its capacity as the Partner’s limited payment-collection agent. Successful payment to the authorised Platform payment flow discharges your corresponding payment obligation to the Partner to the extent of the cleared amount.
10.3 ErryGo may issue its own tax invoice for the Platform Fee. The Partner may issue, or authorise ErryGo to issue on the Partner’s behalf, a separate service receipt, bill or tax invoice for the Partner Charge according to the Partner’s registration status and Applicable Law. A Partner document issued through the Platform remains the Partner’s document and does not make ErryGo the supplier of Partner Services.
10.4 If law requires ErryGo, as an electronic commerce operator or otherwise, to collect, pay or report tax in relation to a Partner Service, ErryGo may do so and recover or include the applicable amount as disclosed. Tax compliance imposed on ErryGo does not by itself alter the commercial allocation in Clauses 5 and 6 except to the extent law mandates.
10.5 The final amount may reflect actual verified time, waiting, distance, approved scope change, cancellation, Third-Party Expense or another pricing component disclosed in the Booking Terms. ErryGo will not add an undisclosed discretionary charge after completion.
You must provide a valid GSTIN and correct billing details before document generation if you require them on an invoice. You are responsible for loss caused by inaccurate tax information. Issued documents may be corrected through a legally appropriate debit note, credit note or cancellation process and will not be silently overwritten.
11. Payments, tips and off-Platform dealings
You authorise ErryGo and its payment service providers to charge the payment method selected for amounts validly due under a Booking. You represent that you are entitled to use that payment method and will not initiate a dishonest chargeback or payment reversal. Failed, reversed or incomplete payments remain payable.
A tip is voluntary. Where the Platform identifies an amount as a tip for the Partner, ErryGo will collect it for and transfer it to the Partner without deducting a platform commission, subject only to deductions required by law and reversal of a fraudulent, erroneous or unsuccessful payment. A tip is not part of the Platform Fee and does not purchase any guarantee or additional duty from ErryGo.
All Booking payments must be made through the payment method authorised by the Platform. You must not ask or encourage a Partner to cancel, understate or move a Platform Booking off the Platform; pay an unauthorised personal QR code or account; or privately continue, repeat or expand the Task to avoid Platform charges, records or safeguards. ErryGo has no responsibility for off-Platform services, payments, promises, property, disputes or losses.
If cash or another direct payment method is expressly enabled for a Booking, follow only the amount and method shown on the Platform and obtain the available receipt. ErryGo is not responsible for additional voluntary or unauthorised payments made directly to a Partner or third party.
12. Third-party expenses, merchants and reimbursements
A Third-Party Expense is separate from the Platform Fee and Partner Charge. You must set and approve the spending limit and, where requested, provide payments through the authorised flow. The Partner is not required to use personal funds. ErryGo may block a Task involving unsupported cash handling, credit, reimbursement or unusually high value.
A Partner may spend or commit money only within your recorded authority. You must promptly reimburse an authorised amount supported by the proof reasonably available for that transaction. If the final amount is less than an advance, the balance must be returned or reconciled through the Platform. If an expense exceeds the limit without your recorded approval, you may dispute the excess, subject to emergency or unavoidable charges expressly contemplated in the Booking Terms.
Third-party prices, taxes, availability, quality, authenticity, warranties, refund rules and timelines are controlled by the relevant merchant or authority. ErryGo does not mark up or assume responsibility for a Third-Party Expense unless a separate charge is clearly disclosed. A receipt collected from a merchant is the merchant’s document.
You are responsible for deciding whether to purchase, repair, alter, submit, collect or accept a third-party item or service. The Partner may relay information and carry out your recorded choice but is not your professional adviser and need not evaluate legal, financial, medical, technical or commercial consequences.
13. Cancellations, rescheduling, waiting and refunds
13.1 You may cancel or request rescheduling through the Platform. No cancellation fee applies before Partner acceptance unless a clearly disclosed non-refundable third-party amount has already been incurred. After acceptance, a disclosed cancellation charge may apply to compensate reserved Partner time, travel, waiting, Platform processing or authorised expenses.
13.2 The applicable cancellation or rescheduling amount, if any, will be shown before you finally confirm cancellation or rescheduling. No amount will be charged where it was not disclosed in accordance with Applicable Law. ErryGo will observe any statutory requirement for parity where an e-commerce entity itself cancels an order unilaterally.
13.3 Waiting or no-show charges may begin after the grace period shown in the Booking Terms if you, the Recipient, premises, merchant or required contact is unavailable, inaccessible or not ready. Continued waiting is subject to Partner availability. A Partner may leave after the permitted waiting period and the Booking may be treated as Customer-cancelled or partially performed.
13.4 ErryGo or a Partner may cancel or stop a Task for safety, illegality, prohibited content, material misdescription, abusive conduct, missing access, non-payment, unavailable capacity, force majeure or a material change that the Partner did not accept. Amounts for work already performed, waiting, travel or non-recoverable authorised expense may remain payable where the reason is attributable to you.
13.5 If no Partner is available, the assigned Partner cancels without a Customer-attributable reason, or ErryGo cannot facilitate an unperformed prepaid Booking, ErryGo may offer substitution or rescheduling; if you decline or fulfilment is not reasonably possible, ErryGo will process a refund of the prepaid amount attributable to the unperformed part, subject to lawful deductions and any non-refundable third-party amount.
13.6 Accepted refunds will be initiated to the original payment method or another lawful method within a reasonable period and remain subject to bank and payment-provider processing time. A temporary authorisation, failed payment or chargeback is governed by the relevant payment provider.
Refunds, credits, replacement assistance or support offered as a commercial resolution do not constitute an admission that ErryGo supplied the Partner Services, employed the Partner or is legally liable for the underlying event.
14. Customer conduct, premises and safety
You must treat every Partner and support representative with dignity, courtesy and respect and must not discriminate on the basis of sex, gender, gender identity, sexual orientation, caste, religion, race, ethnicity, nationality, disability, age, marital status or any other protected characteristic.
You must provide a lawful, reasonably safe, adequately lit and accessible environment; disclose material hazards, contagious conditions, aggressive animals, construction, unsafe equipment, stairs, restricted access and surveillance; obtain building or third-party permission; keep pets controlled; and provide any customer-supplied equipment or consumable in safe working condition. Where a Task occurs in a private residence or secluded area, a responsible adult must remain reasonably available.
Sexual conduct, harassment, stalking, threats, violence, abusive language, wrongful restraint, unwanted contact, discriminatory behaviour, intoxicated or materially impaired conduct, weapons, retaliation and attempts to obtain a Partner’s personal relationship or private contact information are strictly prohibited. A Partner may immediately stop and leave a Task that appears unsafe, unlawful, abusive or materially misdescribed.
You are responsible for injury, loss, delay or cost caused by an unsafe condition, undisclosed hazard, defective customer equipment, unlawful instruction, interference by you or another person at the location, or failure to secure necessary permission. ErryGo may restrict your Account and preserve or disclose relevant records where lawful.
For an immediate threat or emergency, contact 112 or the appropriate emergency service first. Platform support is not an emergency-response service and cannot guarantee real-time intervention.
15. Prohibited Tasks and restricted items
You must not request, disguise, continue or assist any Task involving:
an illegal act, fraud, theft, bribery, evasion of a legal process, impersonation, false statement, forged document, money laundering, betting or facilitation payment;
weapons, ammunition, explosives, fireworks, radioactive, corrosive, flammable, poisonous, biohazardous or otherwise dangerous substances;
narcotics, unlawful drugs, controlled substances, alcohol, tobacco, prescription medicines or regulated goods except where the Platform expressly enables a lawful category and every legal condition is satisfied;
human remains or body parts, blood or clinical samples, livestock, pets or live animals unless a category is expressly enabled;
sexual services, pornography, trafficking, exploitation, stalking, surveillance, intimidation or harassment;
childcare, unsupervised custody of a minor, patient handling, nursing, medical treatment, medication administration, intimate personal care, emergency response or custodial care of a vulnerable person;
driving your vehicle, passenger transport, use of an unlicensed vehicle, or transport activity requiring a permit or insurance not expressly verified and enabled;
electrical, plumbing, carpentry, gas, structural, appliance repair, hazardous cleaning, work at height or another skilled, licensed or high-risk service not expressly offered on the Platform;
entry without permission, trespass, forced entry, lock bypass, concealment of identity or access to a restricted, unsafe or unlawful location;
sharing or using a password, PIN, OTP, biometric, card credential, bank account, trading account, digital-signature token, Aadhaar authentication or other security credential;
withdrawing cash, operating a financial account, signing a cheque, executing or witnessing a document, voting, sitting an examination, making a sworn declaration or exercising a personal legal discretion for you;
cash, bearer instruments, bullion, precious stones, jewellery, high-value collectibles, original title documents or other valuables beyond a limit expressly enabled and accepted in the Booking;
manual handling beyond the disclosed weight, an unsafe load, hoisting, rope work, dismantling, climbing, or use of industrial equipment without an expressly enabled service and suitable safeguards;
any item you do not own or have lawful authority to handle; or
any other activity identified as prohibited or restricted on the Platform or by Applicable Law.
ErryGo or a Partner may ask clarifying questions, inspect the exterior of an item, require identification or proof of authority, refuse or stop the Task, preserve evidence and report suspected unlawful activity to competent authorities. You must not retaliate against a Partner for a good-faith refusal.
16. Customer property, documents, funds and access
You represent that you own or have lawful authority over every Customer Material and that its description, condition, quantity, value, packaging, destination and handling requirements are accurate. You must identify fragile, damaged, perishable, confidential, hazardous or unusually valuable items and package and label them appropriately. A Partner may refuse inadequately packaged or misdeclared material.
ErryGo never takes physical possession or custody of Customer Materials and is not a bailee, carrier, warehouseman or insurer. Any physical custody is entrusted directly by you to the Partner under the Partner Services contract. Title and risk arising from an inherent defect, pre-existing damage, ordinary wear, leakage, inadequate packaging, concealed fragility, perishability or your instruction remain with you.
Do not provide passwords, OTPs, unrestricted keys, unnecessary original documents or access beyond what is reasonably required. If a temporary key or access device is accepted, you must record handover and return through the available Platform steps and change access credentials promptly where a safety concern arises.
Cash, payment instruments, identity documents and other sensitive Customer Materials may be handled only if the Platform expressly permits that category and within the displayed limit. They must be used solely for the Task and supported by available proof. ErryGo may require a safer alternative or reject the Booking.
Unless the Platform expressly offers protection for a Booking, no insurance or declared-value coverage is included. You are responsible for obtaining appropriate insurance for property whose loss would be material. Any optional third-party cover is governed exclusively by the insurer’s policy, exclusions and claims decision.
If a Recipient refuses delivery or return, or a Customer Material cannot be lawfully or safely handed over, you must promptly provide instructions and bear reasonable return, waiting and authorised storage expense. Customer Materials will be handled or disposed of only in accordance with Applicable Law; ErryGo does not accept a continuing storage obligation.
17. Senior and vulnerable-person assistance
A Task described as senior support, accompaniment or local assistance is limited to ordinary non-medical, non-custodial assistance expressly accepted in the Booking. It is not nursing, healthcare, emergency monitoring, personal care, guardianship, patient transport, mobility therapy, medication management or continuous supervision.
You must ensure that the Recipient has consented, is reasonably capable of participating in the Task, and has access to a responsible family member, guardian, caregiver or emergency contact where appropriate. You must disclose material mobility, communication, behavioural or safety needs before confirmation. A Partner may refuse assistance beyond their capability or the accepted scope.
Neither ErryGo nor a Partner assumes a fiduciary, guardian, caregiver or special relationship merely because a Recipient is elderly, disabled or otherwise vulnerable. In an emergency, the Partner may contact emergency services and the recorded contact but is not required to provide medical care or physically restrain or lift a person.
18. Merchant, tailor and repair-shop Tasks
Where a Partner visits a tailor, repair shop, bank drop box, government counter, courier counter or other merchant or facility, the Partner’s role is limited to the physical assistance and communication accepted in the Booking. The Partner may relay your instructions, collect information, submit or collect authorised items and make an authorised payment.
The Partner does not diagnose defects, select technical specifications, certify quality, authenticate goods, negotiate beyond your recorded authority, approve a repair or alteration, give legal or financial advice, or guarantee a third party’s price, workmanship, timeline, warranty, return policy, opening hours or conduct.
The contract for the merchant’s goods or services is directly between you and the merchant. Merchant estimates may change after inspection. You must remain reachable for decisions; delay or non-completion caused by your unavailability or a merchant is not a failure of Platform Services. ErryGo may facilitate communication but is not required to pursue a merchant claim for you.
Where you direct a sealed cheque or document to be placed in an authorised drop box, the Partner does not verify its contents, validity, signature, legal effect or acceptance. The relevant bank, authority or recipient alone determines receipt and processing.
19. Completion, OTPs and service disputes
A Booking may require check-in, check-out, photograph, merchant receipt, OTP, signature, location event, Recipient confirmation or other proof. You must not share a completion OTP or confirm completion until the accepted Task has been completed or the agreed partial completion is accurately recorded.
If you direct unattended handover, doorstep placement, drop-box submission or delivery to a person other than the named Recipient, risk passes to you when the Partner follows the recorded instruction and submits the required proof. ErryGo and the Partner are not responsible for later theft, tampering, weather exposure, rejection or unauthorised access except to the extent caused by proven breach of the recorded instruction.
Report a genuine discrepancy promptly through support with the Order ID and available proof. ErryGo may compare Platform Records, contact the Partner, Recipient or merchant, and correct an obvious time, charge or completion error. Platform Records are relevant evidence but are not conclusive and may be challenged with credible contrary material.
A disputed or incomplete Task does not entitle you to retain an unrelated amount, make a false chargeback or publish knowingly false allegations. ErryGo may temporarily hold a Partner settlement or customer refund while reasonably verifying entitlement, without thereby accepting liability for Partner Services.
20. Communications, location and Platform Records
You authorise ErryGo and the assigned Partner to contact you or the Recipient through in-app communication, telephone, SMS, push notification, email or WhatsApp for registration, verification, Booking operation, safety, payment, support and legally required notices. Transactional communications are integral to the Platform; disabling them may prevent use. Promotional communications will be governed by your choices and Applicable Law.
The Platform may process location, route, time, device, call-masking, chat, image, receipt and other Platform Records for matching, fulfilment, fraud prevention, payment, safety, support, dispute resolution and legal compliance as described in the Privacy Policy. Calls or communications may be recorded or monitored where lawful and after any notice required by law.
You must use Platform communication for material instructions and must not publish, misuse or retain a Partner’s personal information for an unrelated purpose. Contact details supplied for a Booking may be used only for that Booking and legitimate follow-up concerning it.
21. User Content, reviews and feedback
You retain ownership of User Content. You grant ErryGo a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt, communicate and use User Content for operating, securing, improving and enforcing the Platform, resolving disputes and complying with law. For a public review or feedback, the licence is perpetual and includes use for truthful promotion, subject to the Privacy Policy and Applicable Law.
You are responsible for User Content and represent that you have all necessary rights and consents. User Content must not:
belong to another person without authority or infringe privacy, confidentiality, copyright, trademark or another right;
be obscene, pornographic, sexually explicit, harmful to a child, invasive of bodily privacy, discriminatory, hateful, threatening, violent, harassing or defamatory;
impersonate another person, conceal its origin, or knowingly communicate misinformation or materially false or misleading information;
promote unlawful gambling, money laundering, regulated contraband or any unlawful act;
threaten India’s sovereignty, integrity, defence, security, friendly relations, public order, or incite or obstruct investigation of an offence;
contain malware or code designed to disrupt or gain unauthorised access; or
otherwise violate Applicable Law or these Terms.
ErryGo may moderate, preserve, restrict or remove User Content; suspend the responsible Account; and make disclosures required or permitted by law. ErryGo does not endorse User Content or assume liability for content supplied by a Customer, Partner or third party. Complaints concerning unlawful content may be submitted under Clause 33.
22. Acceptable use and prohibited technology activity
You may use the Platform only through authorised interfaces and for its intended purpose. You must not:
copy, sell, sublicense, frame, mirror, commercially exploit or create a competing service from the Platform or its data;
scrape, crawl, index, harvest, systematically retrieve or build a database from Platform content, Partners or Customers;
use a bot, script, emulator, modified application, automated booking tool or other unauthorised means;
reverse engineer, decompile, bypass, probe or interfere with security, identity, location, pricing, payment, allocation or fraud controls;
introduce malware, overload systems, test vulnerabilities without written permission, or disrupt another person’s use;
create duplicate or fraudulent Accounts, manipulate offers, ratings, referrals, time, location, proof or payments; or
use the Platform or Platform information to harass, solicit, recruit, discriminate against or unlawfully profile another person.
ErryGo may use proportionate technical measures, preserve evidence and cooperate with authorities to prevent or investigate misuse. Security research requires ErryGo’s prior written authorisation and compliance with any published responsible-disclosure process.
23. Platform licence and intellectual property
Subject to these Terms, ErryGo grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the customer Platform for permitted Bookings. No other right is granted.
The Platform, software, interface, databases, designs, text, graphics, workflows, trademarks, domain names, logo and other content are owned by or licensed to ErryGo and are protected by intellectual-property law. “ErryGo” and “ErryGo Partner” branding may not be used to suggest sponsorship, employment, agency, endorsement or affiliation without written permission.
Feedback about the Platform may be used by ErryGo without restriction, attribution or compensation, provided that this does not transfer ownership of your confidential personal data or public review beyond the licence in Clause 21.
24. Third-party technology and services
The Platform may rely on or link to third-party payment processors, maps, telecommunications, identity-verification providers, cloud services, merchants, insurers and external websites. Their services are governed by their own terms and privacy practices. ErryGo does not control and, to the maximum extent permitted by law, is not responsible for their availability, accuracy, security, delay, rejection or other act or omission.
Map, route, distance, traffic, address and merchant information may be approximate or supplied by third parties. You must verify critical information. A link, listing or integration does not constitute endorsement or a warranty by ErryGo.
If a payment is debited but the Booking is not confirmed, reconciliation and reversal may depend on the payment provider. ErryGo will provide reasonable assistance using records under its control but does not guarantee the provider’s processing time.
25. Offers, discounts and credits
ErryGo may introduce, modify or withdraw an offer, referral, trial, discount or promotional credit subject to the terms disclosed before use. Unless stated otherwise, an offer is personal, non-transferable, not redeemable for cash, limited to one Account, device, payment instrument, address or household, and cannot be combined with another offer.
ErryGo may reject or reverse a benefit obtained through duplicate Accounts, collusion, manipulation, chargeback, misrepresentation or breach of offer terms. A change will not ordinarily remove a benefit validly applied to a confirmed Booking, except to correct an obvious error or fraud.
A discount may be funded and allocated between ErryGo, a Partner or a third party as shown in transaction records. The allocation does not change the separate-supply structure in Clause 5.
26. Suspension, refusal and termination
Your access is conditional and revocable. ErryGo may immediately refuse a Booking, restrict features, cancel an active Task, suspend or terminate an Account, require re-verification, remove User Content or preserve payments and records where reasonably necessary for safety, suspected fraud, abusive conduct, identity misuse, unlawful activity, non-payment, chargeback misuse, prohibited Tasks, repeated cancellations, misuse of refunds or offers, risk to another person, material breach, legal direction or protection of the Platform.
ErryGo may also modify or discontinue a service area, Task category, feature or the Platform for a legitimate commercial, technical, legal or operational reason. Where no immediate concern exists, reasonable notice will be given where practicable and required by law. No Customer has a proprietary right to a feature, Partner, price, promotion or continued availability.
You may stop using the Platform and request Account deletion through the available flow. Termination does not affect accrued payment obligations, pending Bookings, valid claims, investigation, record retention required by law, or provisions intended to survive, including payment, IP, confidentiality, indemnity, liability, dispute and electronic-record clauses.
27. Platform disclaimers
To the maximum extent permitted by Applicable Law, the Platform and Platform Services are provided on an “as available” basis. Except for an express Booking commitment or a warranty that cannot lawfully be excluded, ErryGo disclaims implied warranties of uninterrupted availability, error-free operation, merchantability, fitness for a particular purpose, non-infringement, accuracy and any warranty arising from course of dealing or usage.
ErryGo does not guarantee:
that a Task will be accepted, assigned, started or completed at a particular time;
the quality, legality, safety, honesty, solvency, identity or conduct of a Partner, Customer, Recipient, merchant or third party;
a particular merchant outcome, queue position, repair, alteration, purchase, approval, refund, collection or delivery result;
that verification, ratings, support, safety features, insurance or monitoring will prevent misconduct or loss;
the accuracy of third-party, map, route, distance, price, duration, demand or availability information; or
that Platform communications, data or files will never be delayed, lost, intercepted or affected by an event beyond reasonable control.
No oral statement by a Partner, support representative or third party creates a warranty or expands ErryGo’s obligations unless ErryGo confirms it in a written Booking Term or formal communication.
28. Partner conduct and allocation of responsibility

To the maximum extent permitted by Applicable Law, ErryGo is not responsible or vicariously liable for a Partner’s act or omission, whether occurring before, during or after a Task, including negligence, delay, non-performance, misrepresentation, fraud, theft, harassment, discrimination, sexual misconduct, assault, violence, property loss or damage, misuse of money or information, traffic conduct, injury, death or another civil or criminal act.
The Partner acts independently and on a principal-to-principal basis. Assignment through the Platform, price guidance, collection of the Partner Charge, use of the ErryGo name or identification, verification, ratings, support, safety tools, proof requirements, suspension rights, facilitation of refunds or cooperation with an investigation do not create employment, agency, partnership, day-to-day control, custody, a guarantee of conduct or an assumption of the Partner’s liability by ErryGo.
Subject to non-waivable law, a claim arising from Partner Services or Partner conduct must be pursued against the responsible Partner. On a lawful request, ErryGo may provide reasonably necessary Partner information, preserve Platform Records, restrict an Account, facilitate communication or a commercial resolution, and cooperate with police, regulators, insurers or courts. Such assistance is discretionary except where law requires it and is not an admission of liability.
Nothing in this clause excludes liability directly caused by ErryGo’s own fraud, wilful misconduct, breach of a non-waivable statutory duty or other liability that Applicable Law does not permit ErryGo to exclude.
29. Limitation of ErryGo liability
29.1 ErryGo is liable only for direct and reasonably foreseeable loss proven to have been caused by ErryGo’s own breach of its obligations in supplying Platform Services. ErryGo is not liable for loss attributable to Partner Services, a Partner, a merchant, a third party, your instruction or omission, inaccurate or incomplete information, an off-Platform dealing, a prohibited Task, an undisclosed risk, Customer Materials, a payment provider, or force majeure.
29.2 To the maximum extent permitted by law, ErryGo will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profit, revenue, business, opportunity, goodwill, reputation, anticipated saving or data; emotional distress not independently recoverable under Applicable Law; or the cost of substitute arrangements, even if advised that such loss was possible.
29.3 Subject to Clause 29.4, ErryGo’s aggregate liability to you arising from or connected with these Terms, the Platform and all Bookings will not exceed the greater of: (a) the aggregate Platform Fees actually paid by you to ErryGo during the three months immediately preceding the event giving rise to the claim; or (b) INR 5,000. Amounts collected for a Partner, tip or third party are not Platform Fees and do not increase this cap.
29.4 Nothing in these Terms excludes or limits: (a) ErryGo’s fraud or wilful misconduct; (b) death or personal injury directly caused by ErryGo’s gross negligence; (c) a non-waivable consumer, data-protection or other statutory liability; or (d) a remedy that Applicable Law expressly prohibits the parties from excluding or limiting.
29.5 Recovery from a Partner, merchant, insurer, payment provider or other responsible person for the same loss will reduce any duplicative recovery against ErryGo. You may not recover more than the loss actually established.
The limitations in this clause are an agreed allocation of risk reflecting that ErryGo receives only the Platform Fee for its limited role. If a limitation is unenforceable, it will apply to the greatest extent lawfully permitted rather than being disregarded in full.
30. Customer indemnity
To the extent permitted by law, you will indemnify, defend and hold harmless ErryGo, its affiliates, directors, officers, employees and representatives from third-party claims, proceedings, penalties, losses, damages and reasonable legal costs to the extent arising from or attributable to:
your breach of these Terms, Booking Terms or Applicable Law;
an unlawful, unsafe, prohibited, false or materially incomplete Task or instruction;
your fraud, negligence, wilful misconduct, harassment, violence, discrimination or misuse of a Partner’s information;
Customer Materials, including your lack of title or authority, misdescription, dangerous condition, inadequate packaging or infringement of third-party rights;
an unsafe premises, defective customer equipment, animal, person or condition under your control;
User Content or information provided without required rights or consent;
an off-Platform dealing, unauthorised payment or promise initiated or accepted by you; or
the act or omission of a Recipient or other person for whom you are responsible under Clause 3.
This indemnity applies only to the extent the claim or loss is attributable to you and does not cover loss caused by ErryGo’s fraud, wilful misconduct or negligence. ErryGo may control the defence after reasonable notice. You must cooperate and must not settle a claim imposing liability, admission or obligation on ErryGo without its written consent.
31. Incidents, claims and cooperation
For safety incidents, theft, loss, property damage, harassment, assault or suspected crime, take reasonable steps to protect people and evidence and contact emergency services or police where appropriate. Report the incident to ErryGo as soon as reasonably practicable, preferably within 24 hours, so that records can be preserved and operational action considered. A delay may impair investigation but does not extinguish a statutory right that cannot lawfully be restricted.
A report should include the Order ID, date and time, description, photographs or video lawfully obtained, receipts or proof of value, witness or merchant details, police or medical record where applicable, and any other reasonably requested material. Do not alter, fabricate, conceal or publicly disclose sensitive evidence in a way that harms another person or investigation.
ErryGo may investigate for Platform safety and account action, but is not a court, police authority, insurer or adjudicator of criminal or civil guilt. ErryGo may preserve and disclose Platform Records as required or permitted by law and may refer you to the Partner, merchant, insurer, payment provider or authority responsible for the claim.
Knowingly false, fraudulent, abusive or retaliatory claims may result in Account restriction, recovery of improper refunds and reporting to authorities. Good-faith reporting will not be penalised merely because an allegation cannot be established.
32. Privacy and personal data
ErryGo processes personal data in accordance with its Privacy Policy and Applicable Law. The Privacy Policy explains categories of data, purposes, sharing, retention, security, rights and grievance routes. These Terms do not replace the Privacy Policy or seek consent for processing that requires a separate, specific notice or choice.
To facilitate a Booking, you authorise ErryGo to share with the assigned Partner and relevant merchant the minimum information reasonably required, which may include your or the Recipient’s name, contact channel, location, instructions and access details. The Partner receives that information only for the accepted Task and is independently bound not to retain or misuse it.
If you provide another person’s personal data, you represent that you have lawful authority and have given any notice or obtained any consent required for the stated purpose. Do not submit unnecessary identity, financial, health or other sensitive information in free-text instructions.
Account closure or deletion does not require immediate deletion of records that ErryGo must or may lawfully retain for tax, accounting, fraud prevention, safety, disputes, legal compliance, enforcement or defence of claims.
33. Customer care and grievance redressal

ErryGo will acknowledge complaints within 24 hours and resolve them within seven days of receipt. Any complaint subject to a shorter statutory period will be handled within that period. This includes taking reasonable and practicable measures within two hours in respect of complaints covered by Rule 3(2)(b) of the IT Rules. Where applicable, an aggrieved person may appeal to the Grievance Appellate Committee in accordance with the IT Rules.
A complaint should, where applicable and available, identify the relevant Account, Order ID or content link; describe the issue and requested resolution; and include any relevant supporting information. ErryGo may request identity verification or other information reasonably necessary to investigate the complaint and prevent impersonation, fraud or misuse.
Complaints concerning Partner Services may be submitted through ErryGo for transmission to, and coordination with, the relevant Partner. Providing this grievance channel does not make ErryGo the supplier of Partner Services or transfer the Partner’s liabilities to ErryGo, except to the extent expressly required by non-waivable law. Customers remain free to approach any consumer forum, government helpline, regulator, police authority or other remedy available under applicable law.
34. Dispute resolution, governing law and jurisdiction
These Terms are governed by the laws of India. The parties should first raise the dispute through Clause 33 and attempt good-faith resolution for 30 days, unless urgent relief, safety, a limitation period or Applicable Law requires earlier action.
Any dispute that is legally capable of arbitration and is not pursued under a non-waivable consumer or statutory remedy will be referred to a sole independent arbitrator mutually appointed by the parties. If the parties do not agree, appointment will be made in accordance with Section 11 of the Arbitration and Conciliation Act, 1996. The seat and legal place of arbitration will be New Delhi; proceedings may be conducted virtually; the language will be English, or Hindi where reasonably requested and practicable; and the proceedings will remain confidential except where disclosure is required by law or to enforce an award.
Nothing in the arbitration clause prevents either party from seeking urgent interim relief, reporting or prosecuting a criminal offence, approaching a regulator or statutory authority, or using a consumer commission or other remedy whose jurisdiction cannot be excluded by contract. An arbitration clause does not bar a consumer from invoking remedies available under consumer-protection law.
Subject to the preceding paragraph and mandatory jurisdiction under Applicable Law, courts in New Delhi will have exclusive jurisdiction over non-arbitrable disputes and arbitration-related proceedings.
35. Changes, notices and electronic records
ErryGo may update these Terms prospectively to reflect changes in law, safety, technology, pricing, products or Platform operation. The updated version and effective date will be published on the Platform. Material changes will be notified through the Platform or a registered contact channel before taking effect, and affirmative acceptance will be obtained where required. Immediate changes may apply where reasonably necessary for safety, fraud prevention, legal compliance or protection of the Platform.
The Terms and Booking Terms in effect when a Booking is confirmed ordinarily govern that Booking. A later change will not retrospectively impose a new price or reduce an accrued statutory right. Continued use after a notified change takes effect constitutes acceptance only to the extent permitted by law.
Operational notices may be sent by in-app message, push notification, SMS, WhatsApp, email or another registered channel. Legal notices to ErryGo should be sent to help@errygo.com and the address in Clause 33. You must keep your contact details current.
You consent to electronic contracting and records. ErryGo may retain the Terms version, selected language, acceptance screen, timestamp, Account, OTP or authentication, device and technical records, Booking confirmations and later acceptance. Electronic records and acceptance have the effect recognised under Applicable Law, and no wet-ink signature or company stamp is required.
ErryGo may periodically remind users of these Terms, the Privacy Policy and platform rules and may require re-acceptance or suspend access until acceptance is completed.
36. General terms and acceptance
36.1 Entire agreement. These Terms, incorporated policies and Booking Terms are the entire agreement concerning customer use of the Platform and supersede earlier customer communications on the same subject, except fraud and any separate written enterprise agreement signed by ErryGo.
36.2 Assignment. You may not transfer your Account, Booking or rights or obligations without ErryGo’s written consent. ErryGo may assign these Terms to an affiliate, successor, purchaser or entity acquiring the relevant business or assets, subject to Applicable Law.
36.3 No waiver. A delay or failure to exercise a right is not a waiver. A waiver must be specific and in writing by an authorised representative.
36.4 Severability and lawful modification. If a provision is unlawful or unenforceable, it will be modified to the minimum extent necessary to make it lawful and enforceable, and the remainder will continue. If modification is not possible, only the affected part will be severed.
36.5 No third-party enforcement. Except for ErryGo parties expressly protected by an indemnity or limitation, no person has a contractual right to enforce these Terms. This does not limit rights arising independently under law.
36.6 Interpretation. Headings are for convenience. “Including” means “including without limitation”; singular includes plural; and a reference to law includes amendments and replacements. A rule protecting ErryGo also protects its affiliates, directors, officers, employees and representatives where the context permits.
36.7 Language. These Terms may be made available in English and other languages. If a translation conflicts with the English version, the English version will prevail to the extent permitted by law; however, no translation rule will defeat a right that law grants based on the language actually presented and accepted.
36.8 Survival. Payment, property, User Content licence, intellectual property, confidentiality, disclaimers, Partner responsibility, liability, indemnity, claims, disputes and electronic-record provisions survive termination to the extent necessary.
YOUR ACCEPTANCE By selecting “I agree”, creating or using an Account, or confirming a Booking, you confirm that you had access to these Terms, understood the marketplace structure and separate Partner contract, had an opportunity to review the charges and Booking Terms, and intend to be legally bound. |
